Article 1 – Definitions
In these General Terms and Conditions, the following terms shall have the meanings indicated below:

  • Grace Period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: A natural person who, for purposes other than business or professional, enters into a distance contract with the entrepreneur.

  • Entrepreneur: A natural or legal person offering products and/or services to consumers remotely.

  • Distance Contract: An agreement concluded between the entrepreneur and the consumer, without the physical presence of the parties, using distance communication techniques (e.g., online platforms).

  • Right of Withdrawal: The consumer's right to cancel the distance contract within the cooling-off period.

  • Product: Any item offered by the entrepreneur for sale.

Article 3 – Applicability
These terms apply to all offers made by the entrepreneur and to any distance contract entered into between the entrepreneur and the consumer. Prior to the conclusion of the contract, the text of these terms will be made available to the consumer. If this is not reasonably possible, the entrepreneur will inform the consumer where these terms can be viewed and offer them for free upon request.

Article 4 – The Offer

  • The offer is valid for a limited period or as long as stocks last, as specified in the offer.

  • All offers are without obligation and subject to change.

  • The offer will include a detailed description of the products/services, enabling the consumer to make an informed decision.

  • Images of products are indicative and may not represent the actual product.

  • The offer will clearly specify the price, including VAT, any additional charges (e.g., shipping), and applicable conditions for acceptance.

Article 5 – The Agreement

  • The agreement comes into effect when the consumer accepts the offer and the terms are met.

  • If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of this acceptance. Until this confirmation is received, the consumer may cancel the agreement.

  • The entrepreneur will ensure appropriate technical and organizational measures to protect the transfer of electronic data and ensure a secure environment for electronic payments.

  • The entrepreneur will send the consumer confirmation of the agreement, including all required information such as contact details, return policies, and payment terms.

Article 6 – Right of Withdrawal

  • For Products: The consumer has 14 days after receipt of the product to withdraw from the agreement without providing a reason.

  • For Services: The right of withdrawal for services applies for 14 days from the conclusion of the contract.

  • The consumer must return the product in its original condition and packaging, following the entrepreneur’s provided return instructions.

Article 7 – Costs in Case of Withdrawal

  • The consumer bears the costs of returning the product.

  • Any amount paid by the consumer will be refunded within 14 days of the entrepreneur receiving the return, using the same payment method as the consumer originally used, unless otherwise agreed.

Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for:

  • Customized products or services made per the consumer's specifications.

  • Products that spoil quickly or have a limited shelf life.

  • Sealed goods that cannot be returned for health or hygiene reasons once opened.

  • Digital content that was sealed and opened by the consumer.

Article 9 – The Price

  • Prices are fixed for the duration of the offer, except in cases where VAT changes or other legal obligations require a price adjustment.

  • All prices are inclusive of VAT unless stated otherwise.

  • The entrepreneur is not liable for misprints in the offer.

Article 10 – Compliance and Warranty

  • The entrepreneur guarantees that the products conform to the contract and are free from defects.

  • If the product is defective, the consumer must report this within 4 weeks of receiving the product.

Article 11 – Delivery and Execution

  • Delivery will occur as soon as possible, and within 30 days unless otherwise agreed.

  • If delivery is delayed, the consumer will be informed, and they may cancel the agreement with a full refund.

Article 12 – Continuing Performance: Duration, Termination, and Extension

  • The consumer can terminate an ongoing contract for the regular supply of goods or services by giving one month’s notice.

  • Fixed-term contracts will not automatically renew, except for newspaper/magazine subscriptions.

Article 13 – Payment

  • Payments should be made within 7 days of receiving the confirmation of the agreement.

  • In case of non-payment, the entrepreneur may charge reasonable costs for debt recovery.

Article 14 – Complaints Procedure

  • The entrepreneur will address complaints according to an established procedure.

  • Complaints should be reported within 7 days, and a response will be provided within 14 days.

Article 15 – Disputes

  • Dutch law applies to any agreement between the entrepreneur and consumer, regardless of the consumer's location.

Article 16 – Additional or Different Provisions

  • Any additional terms or deviations from these general terms must be recorded in writing and cannot disadvantage the consumer.
